Laws of Intestacy

If you pass away without leaving a valid will, your estate will be dealt with in accordance with statutory Intestacy Law. This affects who can apply for probate in order to administer your estate legally, and who will benefit in the event of your death. Probate adheres to a strict next-of-kin hierarchy in the order of spouse, adult children, parents, siblings, and so on – and obviously doesn’t factor in the strength, closeness or dependency of interpersonal relationships or ‘family ties’. For example, common-law spouses have no entitlement under Intestacy Law, so not having a will can lead to tense and stressful situations, and potentially divisive family disputes. Intestacy Law also dictates how much beneficiaries receive, which can be financially detrimental in many cases, with little or no recourse.

The probate process does not have an appointed Executor – the Intestate Administrator has to deal with everything, including the distribution of assets in accordance with statutory laws, even when they may seem irrational and unfair.

Inheritance Tax

Careful planning can help reduce the amount of Inheritance Tax that may be payable on an estate. A well-prepared will can help ensure that available allowances, exemptions and reliefs are considered alongside your wishes for your estate. Making a Will – a Simple Guide

01.  Call us to schedule your appointment. Typically, we can visit you at home within one week, but can arrange emergency appointments if required.

02. When you appoint IWC, we take your detailed instructions and offer appropriate expert advice regarding the structure of your will and any estate planning.

03. You then have a statutory cooling off period of 14 days. This gives you time to reflect and amend any aspect of your instructions. Of course, you can waive your rights to this cooling off period if you wish to draft your will sooner.

04. If your will is complex, or you need to think about matters further after the cooling off period has lapsed, we can prepare a draft will and email it to you within seven days.

05. Once you have approved the draft, we prepare the final documents and post them within another seven days. If you choose not to have a draft by email, we dispatch the documents within seven days of the cooling-off period ending.

06. You may pay an additional fee to have an advisor present at the signing to ensure the correct procedures are followed.

07. If you have not signed and returned your will within 28 days of us dispatching the documents, we will remind you in writing. If, after a further 28 days, we’ve not heard from you, we’ll write to you again to confirm we are closing the file. We will hold the file, but any amendments will be at additional cost.

08. Once the will has been signed and returned, we check that attestation has been carried out correctly. (1 in 5 aren’t!).

09. Assuming the will is correctly executed, we will send a copy will and retrieval information documents for your family, within 14 working days.

10. Note: if the will is signed incorrectly, we have to begin the process again.

11. All signed wills are then stored in a secure vault until they’re needed. Retrieval upon bereavement is free of charge. Retrieval at any other time incurs the cost of postage.
